What Forgotten Rare is
Forgotten Rare is an educational, organizational, and emotional supportcompanion for families navigating rare disease and complex care. It is not a medical, legal, insurance, financial, mental health, genetic counseling, or emergency service, and it is not HIPAA compliant. Always consult qualified professionals regarding your specific situation.
Eligibility & caregiver accounts
You must be at least 18 years old to create an account. Forgotten Rare is intended for parents, caregivers, and other adults supporting a child or family member. Accounts are not offered directly to children, and you agree not to create an account on behalf of a minor for the minor's own independent use.
Your account
You are responsible for keeping your login credentials safe and for the information you store in the platform. Please do not enter information you would not be comfortable storing outside of a HIPAA-protected environment, and do not upload Social Security numbers, full insurance ID cards, financial account numbers, or other highly sensitive personal information.
Acceptable use
- Do not use Forgotten Rare to harass, harm, or impersonate others.
- Do not upload content that violates someone else's rights or privacy.
- Do not attempt to break, reverse engineer, scrape, or interfere with the platform's security or operation.
- Do not use the platform for the unauthorized practice of medicine, law, insurance, or any other regulated activity.
AI features
Forgotten Rare uses AI to generate educational and emotional support content. Output may be inaccurate, incomplete, or outdated. AI output is not medical, legal, insurance, financial, mental health, or genetic counseling advice. You are responsible for reviewing AI output and confirming it with the appropriate professional before acting on it.
Subscriptions and payments
Premium memberships are billed through our payment provider. You can cancel at any time from the billing portal; refunds are handled on a case-by-case basis. A portion of proceeds supports rare disease families and advocacy efforts in honor of Augyst. Forgotten Rare is not a registered nonprofit unless explicitly stated.
No warranty
Forgotten Rare is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. We do not warrant uninterrupted operation, error-free output, or any particular outcome.
Limitation of liability
To the maximum extent permitted by law, Forgotten Rare, its operators, contributors, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the platform - even if we have been advised of the possibility. Our total liability for any claim is limited to the greater of (a) the amount you paid Forgotten Rare in the 12 months before the claim, or (b) USD $100.
Indemnification
You agree to defend, indemnify, and hold harmless Forgotten Rare and its team from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the platform, your content, or your violation of these terms.
Governing law & dispute resolution
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute arising from these terms or your use of the platform will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction there. Either party may elect binding individual arbitration in lieu of court proceedings. You waive any right to participate in a class action or class arbitration.
Termination
We may suspend or terminate accounts that violate these terms or pose a safety or legal risk. You may delete your account at any time from your account page or by emailing privacy@forgottenrare.com.
Changes to these terms
We may update these terms from time to time. Continued use of Forgotten Rare after changes take effect means you accept the updated terms.
